These Terms of Service ("Terms") govern your use of Oliver: Provable Witness ("Oliver", "the app"), developed by Kuip Limited. By downloading, installing, or using Oliver, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Oliver, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the app.

2. Description of Service

Oliver is a media authentication tool that creates cryptographic hash chains and C2PA manifests for photos, videos, audio, and sensor data. The app enables you to capture, import, verify, and share tamper-evident media.

3. Eligibility

You must be at least 13 years old to use Oliver. By using the app, you represent that you meet this age requirement.

4. User Content

You retain full ownership of all media and data you create, import, or process through Oliver. You are solely responsible for the content you capture, store, and share using the app.

5. Sensitive Data, Local Storage, and Backup

Oliver is designed to create verifiable records, and the proofs you create may contain sensitive information. Depending on how you use the app, this may include GPS coordinates, compass headings, accelerometer data, photos, videos, audio recordings, and document text.

You are fully responsible for deciding what proofs to create, what information to include in them, and who you share them with. You should assume that any exported or shared proof package may reveal the media and metadata embedded in it.

Oliver does not encrypt your data. Its purpose is to preserve integrity and provenance, not to provide confidentiality or secrecy.

If you use Face (TrueDepth) 3D capture, your proof may include face-related depth geometry and companion image data. Oliver uses this only to create the proof you requested, not to identify you or any other person.

Data you create with Oliver or import into Oliver stays on your device unless you explicitly export, share, or back it up using a third-party service. Oliver and its creators do not operate servers or backend services that receive or store that data. If you enable Google Drive backup, data may also be stored in your Google Drive account. If you delete the app, locally stored data may be permanently removed without any way to recover it unless you have separately exported or backed it up.

7. Cryptographic Verification

Oliver provides cryptographic tools to help establish the integrity and provenance of media. While these tools use industry-standard algorithms (SHA3-256) and specifications (C2PA), they are provided as-is. Oliver does not guarantee that cryptographic proofs will be accepted as legal evidence in any jurisdiction. The admissibility and weight of such evidence is determined by applicable laws and courts.

8. Third-Party Services

Oliver may integrate with third-party services such as Google Drive. Your use of these services is subject to their respective terms and privacy policies. Oliver is not responsible for the practices of third-party services.

9. Intellectual Property

The Oliver app, including its design, code, and branding, is the intellectual property of Kuip Limited. You are granted a limited, non-exclusive, non-transferable license to use the app for its intended purpose.

10. Disclaimer of Warranties

Oliver is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Kuip Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Oliver, including but not limited to loss of data, loss of evidence, or reliance on cryptographic proofs.

12. Indemnification

You agree to indemnify and hold harmless Kuip Limited from any claims, damages, losses, or expenses arising from your use of Oliver or your violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date at the top of this page.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
